WSAZ Cutest Pet Contest

OFFICIAL RULES

 

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

 

1.       PROMOTION DATES

 

a.             The WSAZ Cutest Pets Contest (“Promotion”) will begin on June 10, 2013 at 12:00 a.m. (Midnight) Eastern Time (“ET”) and end on July 2, 2013 at 12:30 p.m. ET.  The deadline for all entries is 11:59:59 p.m. ET on June 16, 2013.

 

2.       ELIGIBILITY RESTRICTIONS

 

  1. The Promotion is open to all legal residents 18 years of age or older who live in the following Charleston Huntington DMA counties in West Virginia, Ohio, and Kentucky: Boyd, Elliott, Floyd, Greenup, Johnson, Lawrence, Lewis, Martin, Pike, Gallia, Jackson, Lawrence, Meigs, Scioto, Boone, Braxton, Cabell, Calhoun, Clay, Jackson, Kanawha, Lincoln, Logan Mason, Mingo, Nicholas, Putnam, Roane, and Wayne  Employees of WSAZ-TV (the “Station”), its parent, subsidiary, and affiliated entities, its advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the Charleston-Huntington DMA metropolitan area, and the members of their immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win.  This Promotion is subject to all applicable federal, state, and local laws and regulations.  Void outside the United States, in NY and FL, as applicable, and where prohibited.

 

  1. Only one winner per household is permitted in any Station-conducted contest/sweepstakes every six (6) months.

 

  1. Winners must provide valid government-isseud photo identification in order to claim the prize.  Winners must sign the WSAZ Contest Affidavit and Release and the WSAZ Publicity Release and Waiver.

 

  1. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent.  The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and will also delete any entry as required by law.

 

 

3.       ENTRY

 

  1. To participate in the Promotion, you may enter via the following method(s):

 

          VIA INTERNET – Follow the links and instructions found in promotional materials at http://wsaz.upickem.net/engine/Welcome.aspx?contestid=89700 to enter and submit your first name and last name, complete address, city, state, zip code, county of residence, telephone number, date of birth, a valid email address, photograph of your pet, and caption for the photo in the in the online entry form.  Professional photographs not accepted.  Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address.  Multiple entrants are not permitted to share the same email address.  Approved entries submitted will receive an approval email.  Entries will not be returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s computer is the official time keeping device for the Promotion.  For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m. ET and shall end at 11:59:59 p.m. ET.

 

VIA ADMINISTRATION ON FACEBOOK  – Each entry via Facebook must include requested information, including the entrant’s first name and last name, complete postal address (street, city, state, and zip code, county of residence), email address, telephone number, date of birth, photograph of your pet, and caption for the photo in the in the online entry form.

 

  1. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By submission of an entry, an entrant releases Facebook from any responsibility or liability for the Promotion’s administration, prizes or promotion. You are providing entry information to WSAZ-TV and not to Facebook. 

 

  1. Regardless of method, only one (1) entry per person and one entry per email address are permitted. Professional photographs not accepted.

 

  1. Contest winners agree that they own the photographs submitted to the Promotion.  Pets must be clearly visible in the photograph. They must sign the WSAZ Contest Affidavit and Release and the WSAZ Publicity Release and Waiver.  Entering the contest and checking the permission box in the submission form grants to Gray Television Group, Inc.  d/b/a WSAZ-TV in Huntington, West Virginia (“Company”) and its successors, licensees and assigns with production of promotion of the Cutest Pets Contest the irrevocable right to use, re-use, adapt, modify, exhibit, distribute, edit and otherwise exploit, the contest registrant your name, likeness, image, photograph, voice, biography, interview, statements and/or performance live and recorded, together with any materials I have submitted to Company, in any and all manner, media or formats now known or hereafter devised, in whole or in part, as edited and otherwise altered at the sole discretion of the Company, its licensees or assigns, throughout the world, in perpetuity.

 

4.       PRIZES

  1. Three (3) grand prizes will be awarded in the Promotion, one for each pet category: Cutest Dog, Cutest Cat, and Cutest Other Pet.

 

  1. The winner of the Cutest Dog voting will receive prizes with an Approximate Retail Value (“ARV”) of $600.00:
    1. From Avalon Dog and Cat Hospital, a gift basket that includes:
  1. One (1)  4 oz. bag of “Lean Treats.”
  2. One (1)  4oz bottle of scented shampoo.
  3. One (1)  8oz package of Gentle Snackers treats.
  4. One (1)  Dog Toy.
  5. One (1) pet Nail Trim certificate. (Includes all 4 paws, Expires August 31, 2013.)
  6. Prize must be picked up at Avalon Dog and Cat Hospital 712 MacCorkle Ave. SW South Charleston, WV 25303 during regular business hours.
  7. One (1) Free General Check-Up Office Visit. (costs for lab work, treatment, medications, and other tests are not included)
  8. One (1) Free Heartworm test   
  9. One (1) twelve (12) month supply of Heartgard Plus and Frontline Plus.
  10. One (1) 24oz bag of Lite Biscuits
  11. One (1) bag of thirty (30) Veggie Dent Chews.
  12. One (1) 16oz bottle of Aloe and Oatmeal Shampoo.
  13. One (1) 16oz Bottle of Aloe and Oatmeal Conditioner
  14. One (1) To-Go Water Dispenser
  15. One (1) rope Frisbee and one (1) fetch toy.
  16. ARV of this gift bundle is $350.00.  Prize must be picked up at Tri-State Veterinary Center at 6474 Merritts Creek Road, Huntington, WV 25702 during regular business hours.
  17. One (1) free pet burial space.  Prize is for the perpetual care lot only. (Perpetual care is defined as a percent of the cost goes into a perpetual care fund to assure the pet owner that the lot will be well maintained. Other costs that will be the responsibility of the pet owner include: preparing the grave, pet casket/vault, and closing the grave.)
  18. ARV of this prize is $200.00.

  1. The winner of the Cutest Cat voting will receive prizes with an ARV of $475.00:

  2. One (1) 2.5 ounce bag of Tarter Control treats
  3. One (1) 4 ounce bottle of Body spray

  6. Prize must be picked up at Avalon Dog and Cat Hospital 712 MacCorkle Ave. SW South Charleston, WV 25303 during regular business hours.

  13. One (1) free pet burial space.  Prize is for the perpetual care lot only.   2. ARV of prize is $20.00.
  3. One (1) Free General Check-up office visit (costs for lab work, treatments, medications, and other tests are not included)
  4. $ 100.00 credit towards any product, medication, or treatment
  5. ARV of this gift bundle is $130.00.  Prize must be picked up at Tri-State Veterinary Center at 6474 Merritts Creek Road, Huntington, WV 25702 during regular business hours..
  6. One (1)1 free pet burial space. .  Prize is for the perpetual care lot only. (Perpetual care is defined as a percent of the cost goes into a perpetual care fund to assure the pet owner that the lot will be well maintained. Other costs that will be the responsibility of the pet owner include: preparing the grave, pet casket/vault, and closing the grave. 
  7. ARV of this prize is $200.00.

  1. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

 

5.       WINNER SELECTION AND NOTIFICATION

 

  1. Decisions of Station management with respect to the Promotion are final.

 

  1. All non-professional photos submitted and approved will be available for voting on the contest website at http://wsaz.upickem.net/engine/Votes.aspx?PageType=VOTING&contestid=89700 beginning June 17, 2013 at 12:00 a.m. (Midnight) ET and ending on June 24, 2013 at 11:59 a.m. ET (the "Preliminary Voting Period"). Members of the general public will be invited to view the photos by going to the website and vote once per day for the Pets they think is the "cutest" in each category of dogs, cats and other pets.
    1. Voting is limited to persons eighteen (18) years of age or older ("Voter" or "Voters").
    2. The use of any automated system to submit votes or multiple registrations under different email addresses is prohibited.
    3. WSAZ or Gray Television, Inc. will not be responsible for misdirected votes.

 

  1. The top ten (10) entries in each category (dogs, cats and other pets) with the most votes at the end of the Preliminary Voting Period will be deemed finalists and will proceed to the Final Voting Period. If there are any ties, a random drawing will determine which entry will move on to the Final Voting Period.

 

  1. Beginning June 24, 2013 at 1:00 p.m. ET and ending on June 30, 2013 at 11:59 p.m. ET (the "Final Voting Period"), members of the general public will be invited to view the photos of top ten (10) finalists in each category by going to the Station’s website and vote once per day for the Pets they think is the "cutest" in each of the three categories dogs, cats and other
    1. Voting is limited to persons eighteen (18) years of age or older ("Voter" or "Voters").
    2. The use of any automated system to submit votes or multiple registrations under different email addresses is prohibited.
    3. WSAZ or Gray Television, Inc. will not be responsible for misdirected votes.

 

  1. Voters are limited to one (1) vote per day per, per category per registered user during the Preliminary and Final Voting Periods.

 

  1. The winning photo will be announced during the WSAZ Midday News 12:00-12:30 p.m. ET on July 2, 2013 and the winner will be notified via email and phone call.

 

  1. Winners must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner may be chosen by random drawing of all approved entries.  If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner will be disqualified and will forfeit the prize.

 

  1. Unless otherwise specified in the prize notification, all prizes or prize certificates may be picked up at the location of the prize offering sponsors at the addresses included in the Prize section above.  The winner will forfeit any prizes or prize certificates not claimed within thirty (30) days of winning.  Prizes or prize certificates will not be mailed to the winner without the winner’s prior written consent in which the winner shall agree to assume its risk of loss.  The Station, its sponsors, or promotional partner(s) are not responsible for the safe arrival of a prize or prize certificate. 

 

6.       CONDITIONS

 

  1. Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.

 

  1. Participating in the Promotion and acceptance of prize constitutes winner’s and guest’s (where applicable) permission for the Station or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Promotion or its sponsors for  purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

 

  1. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification.  By participating and/or accepting a prize, entrants, winners and guests (if applicable) agree to release and hold harmless the Station, its sponsors(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion.  The Station will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.

 

  1. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules.  The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion.  Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws.  Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law.  The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision.  If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Promotion and shall not be required to award a substitute prize.

 

  1. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries.  Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Station’s control.

 

  1. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope  specifying “Official Rules” or “Winner List” to WSAZ Cutest Pets Contest Winner List or Official Rules Request, WSAZ-TV 645 Fifth Avenue, Huntington, West Virginia 25701.  A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the main studio of WSAZ-TV 645 Fifth Avenue, Huntington, West Virginia 25701.  All such requests must be received within thirty (30) days following completion of the Promotion.
